Consultations, Quotes, Proposals, Contracts, and Deposits
When services are requested, The Company will initiate a complimentary, brief, initial phone consultation to learn more about The Client and the project. At the conclusion of this phone call or shortly thereafter, if it was determined that The Company is the right fit for The Client and the request and work should begin, The Company will send a quote. A quote is merely an estimate or a representation of possible fees to be accumulated for the project. The actual fees accumulated may be higher or lower than what appears in the quote. The Company is not bound by the quote in any way. Once The Client acknowledges the quote and expresses the desire to proceed with the project, The Company will begin work and the invoicing period will commence. A la carte projects are billed hourly for time spent. It is impossible to predict exactly how much time a project will require. Once the project has come to satisfactory completion, the invoice will be sent to The Client and payment will be due. Complete payment terms are below. Proposals and contracts are not typically generated for à la carte services, due to the brevity and scope of the project.

Once the Client acknowledges the quote for a monthly package service and expresses the desire to proceed with the project, The Company will draft a proposal and a contract. The proposal is a more formalized quote, which may allow The Client more than one option to choose from, include itemized pricing information, and which will require signature and acceptance in order to proceed. The acceptance of the proposal via signature will initiate The Client's agreement to the contract and terms described therein. The information contained in the proposal and the contract are at the discretion of The Company and are tailored specifically to The Client. Prices listed on this website and in quotes are for the purpose of estimation. Actual proposal pricing and contract terms may vary and are agreed upon by The Company and The Client. The minimum contract term for a package service is 90 days. Contracts are also available in six month periods and annually. A client's signature and acceptance of a contract represents their commitment and involvement to the project and to remitting payment as outlined in their contract for the duration of the contract term. If The Client wishes to cancel their services before completion of the contract term, fees may apply. No refunds are guaranteed. See below for a complete explanation of our cancellation policy. Deposits may be required at the time of contract signing or before work commences. This depends on the nature of the project and is at the discretion of The Company. Deposit terms will be agreed upon between The Company and The Client.

Payment Terms
a. Non-monthly clients: For all non-monthly account holders, payment for à la carte services provided by the Primary Consultant or any Secondary Consultant must be made upon completion of the assignment.
b. Monthly clients: For all monthly account holders (package service clients), payments can be made bi-weekly, monthly, or the entire contract amount may be paid up front (lump sum). Payment terms will be mutually agreed upon by both the Client and the Company by way of proposal and contract, and any change in payment amount, terms, or schedule will require an amendment to the contract.
c. Late fees: The Primary Consultant reserves the right to suspend accounts and services without notice should the Client fail to remit payment of the Company’s invoice(s) within 8 days of the invoice's due date. A late fee of $30 will be applied to each 8-day period of non-payment. An additional $30 fee will be assessed to all cancelled or bounced checks/online payments.
d. Interest on unpaid invoices: The Primary Consultant reserves the right to charge interest on all past-due invoices at a rate of 3% per month, in addition to any late fees or returned check/payment fees.
e. Deposits and/or set-up fees: Depending on the scope and length of the project as set forth in the proposal and contract, a deposit of 25-50% of the total project amount will be required to begin services for monthly customers. Deposit sum and terms are up to the discretion of the Primary Consultant at the time of contract signing and will depend upon the length and size of the project. The Primary Consultant is the only representative of the Company who may change and revise deposit terms. A deposit will be shown as a credit on the client's first invoice, which will be dated 30 days from receipt of deposit. Certain services may require set-up fees. These one-time fees must be paid up-front before the corresponding service begins, and these fees are not included in an initial deposit, nor are they credited on any subsequent invoice. All set-up fees are non-refundable. All deposits are non-refundable once work has started.
f. Account-related expenses: Certain services incur expenses exclusive of the Client's package, such as monthly website subscription and hosting fees, stock images, social media boosting and promotion, and AdWords expenditures, etc. These costs are the responsibility of the Client and, depending on the amount, will either be paid by the Consultant and invoiced to the Client for reimbursement or will be set up for direct billing to the Client's credit card. These costs are unrelated to services provided by the Consultant and are not paid to the Consultant.
g. Notice of price changes: Prices are subject to change at any time without notice. Pricing at time of contract signing as stated on website will always be honored for the term/length of the contract, unless contract length surpasses one year. Active contracts are subject to price review every 12 months on the day after the anniversary of contract establishment date.
h. Booking terms: Minimum booking for à la carte services is two hours. Projects may (and are likely to) last longer than two hours. When the Client books an à la carte service, they are accepting an estimation of time to be billed for their project. Actual invoice billing will reflect time spent, billed by the hour. For example, if a resume preparation project is estimated to take three hours but it actually takes three hours and 45 minutes, the Client will be billed for the duration of the project time — no more and no less.

Payment for Services Rendered
Payment for services rendered is due upon completion of work for à la carte (non-monthly) clients. The Client will receive an invoice from the Company, and the invoice must be paid within 8 days of receipt, or else the Company reserves the right to assess interest and late fees as outlined above.

Payment for services rendered to monthly (package) clients is due upon the payment date(s) both outlined in the contract and shown on the invoice, and the above terms apply.

Retention of Title
The Company reserves the right to retain all of the Client’s materials in its possession until all monies owed to the Company have been paid in full.

Requests for Services
a.
The Primary Consultant or any Secondary Consultant or Team Member may be hired by the hour for à la carte services, with a minimum hourly booking of two (2) hours, and on a monthly basis for all package services. Services may be requested via phone, website, email, or in-person.
b. Service arrangement not official until contract is signed by client and returned to the Company.
c. Unfortunately, 25 Hours cannot accommodate last-minute service requests. Please request services at least 72 hours in advance of your anticipated project start date.
d. Travel Time: If travel is necessary (i.e. for concept meetings and in-person consultations) beyond 30 minutes, travel time will be computed at the US mileage rate of .54 cents per mile plus $20 for mileage beyond a 45-mile radius from zip code 08053.
e. Mailing, postage, and any other costs incurred during execution of services will be added to customer's invoice and may be in addition to amount contracted for service.

Cancellations Subject to the Following Conditions
1.    Less than 48 hours notice given or services already started and interrupted:
     a.    Monthly/Package Clients for whom work has not started: If Client has signed a contract and wishes to cancel a project before it begins, 48 hours notice to the Consultant is necessary, in writing. If a deposit was paid, 25% of the deposit will be retained for preparation time and inconvenience. 75% of the deposit will be returned to the customer and the contract will be voided.
     b.    Monthly/Package Clients for whom work has been underway for less than one billing cycle: If notice of cancellation is received after services have begun, the entire deposit will be retained by the Company, and the Client will be billed an hourly rate for work already completed.
     c.    Interruption/Cancellation of a recurring monthly project: The Client is responsible for notifying the Consultant in writing a full 30 days before their next billing cycle to stop work. This will ensure that the current invoice/billing period, once paid, will be final. If the Client notifies the Consultant after a billing period has already begun, the Client will be billed an hourly rate for work completed during the current invoice period. No percentage of the deposit will be refunded, and the Client may be subject to a penalty of 10% of the monthly invoice for the months remaining on the contract.
     d.    Non-Monthly/à la carte Clients (for whom a deposit has not been taken): If notice of cancellation is given 48 hours or less from the contracted project start date, and work has not begun, the Client will be charged an hourly rate up to 50% of the total quoted project cost. This will be invoiced and payment will be due within 15 days of the invoice due date. The project contract will be voided. If notice of cancellation is given after work has already begun, the Client will be charged the full quoted price of the à la carte service, and the invoice payment will be due immediately.
2.    If notice of cancellation for any project is given at least 72 hours in advance and no work has been completed:
     a.     90% of the deposit for monthly services will be refunded and the contract voided.
     b.     Contract will be voided and no payment will be due for à la carte services.

Refund Policy
No refunds will be given for work completed. The Primary Consultant, Secondary Consultant(s) and other Team Members of the Company will make every effort to ensure client satisfaction, within reasonable parameters and in accordance to contracted project deadlines. As per the above Cancellation Policy, 90% of the deposit will be refunded to package clients who have given notice of cancellation in writing at least 72 hours in advance of the project start date, and no fees will be due from à la carte clients who have provided notice of cancellation in writing at least 72 hours in advance of a project start date.

Overruns and Extensions
The Company may bill for additional charges should an assignment last beyond the duration originally specified/intended by the Client, which is beyond the control of the Company and the Primary Consultant (e.g. including but not limited to the Client requesting additional work beyond the scope of the contract, etc.). If the work cannot be completed within the agreed amount of time due to unforeseen difficulties, complications, or other delays, 25 Hours or their agent and the Client agree to amend the contract either verbally or in writing, to provide for additional time as required to complete the work. If the Client does not approve the change before the extension or overrun is to begin, the work will be considered complete at the expiration of the original time allotted, and payment for the full contracted amount on the invoice will be due. All overruns and extensions will be notated and itemized on the invoice, and once extension work has been completed, it must be paid. No renegotiations will be entertained for extension work performed according to an amended contract.

If project overrun or extension is a result of the Client’s dissatisfaction with completed work, the Company will make reasonable efforts to amend the work and will charge half the hourly rate for duration of the extension or until satisfactory completion of project is reached. If extension fees have already been paid in full and the Client expresses dissatisfaction with the work without wishing to commission further revisions, a credit of 50% of the extension fees will be reimbursed to the Client.

Completion of Work and Use of Deliverables
Work is considered complete when the Primary Consultant or any Secondary Consultant or Team Member of 25 Hours provides the Client with the contracted goods or services up to the end of a contract term. This includes copy material, documents and files, creative work, and any other deliverables requested. Final deliverables of content marketing and à la carte services may be provided either digitally, in print, or both, as agreed upon by the Company and the Client. Content and materials may not be copied, distributed, or used in any form besides the original contracted intent, without express written permission from the Primary Consultant.

Revisions
Each signed contract includes up to two (2) revisions for work completed, which can be requested at any stage of the project, upon project completion, or within thirty (30) days of the project completion date. Revisions causing project deadlines to extend beyond the contracted date will require an amendment to the contract and an hourly rate for the extended term at 50% of the normal hourly rate. See Overruns and Extensions above for more information.

Note: Revisions are considered a normal part of the content marketing and copywriting process. Revisions within the scope of the normally contracted work do not indicate client dissatisfaction. Client dissatisfaction occurs when the Client is unsatisfied with the work delivered after the two (2) included revisions have been made and only if the Client expresses in writing their complaint and desired resolution in a manner reasonably plausible for the Company to remedy.

Revisions are all-inclusive and can be minor in scope or can include a partial or complete re-working of a project. Beyond the two (2) contract-inclusive revisions, additional revisions which fall within the realm of the project completion deadline will be billed and invoiced at 25% of the normal hourly rate. Revisions beyond the two (2) contract-inclusive revisions causing the project deadline to be extended will be subject to the above terms of Overruns and below terms of Complaints and Requests for Amended Work (50% of the normal hourly rate).

The Company reserves the right to limit or cap the number of project extensions and revisions at any time and to cease, terminate, or transfer ownership of a service or project. A secondary contract may be proposed for revisions and overruns in excess of what is deemed reasonable by the Company. At such a time, the scope of work will be renegotiated.

Complaints and Requests for Amended Work
If the Client is for any reason dissatisfied with the quality of the work received after their two (2) contract-allowed revisions have been made, the Client may either request a project extension at 50% of the hourly rate for the duration of the service, or they may request a Company Credit good for one complimentary à la carte service to be used within one year.

In order for Consultants to efficiently rectify complaints and remedy Client issues, dissatisfaction must be reported by the Client in writing within thirty (30) days of completion of the service.

Custom Website Design Services
The Company builds new websites and can (in ideal situations) redesign and transfer existing ones. A consultation will be held between the Company and prospective Client to determine scope of work. Depending on the Company's capacity, a consultant may take on the website project. Website projects are available in three tiers, broken down into corresponding term lengths. Payments can be made in installment and a proposal and contract will be created by the Company at the discretion of the Consultant. Work will not begin until Client accepts proposal and contract and makes deposit. Consultation meetings and calls are included in the cost of the project (up to a certain number). Client is responsible for any fees associated with website ownership, such as domain purchase/renewal, hosting, monthly subscription fees, or graphic design costs. Clients who wish to transfer existing sites must provide adequate information regarding hosting and site management. Client must either provide all content for site or acknowledge that the total cost of the project will be higher if content is crafted by a Consultant. The Company is not responsible for any delays due to technical difficulties arising from misinformation, complications with transfer, or Client's failure to pay any associated fees. Upon project completion, ongoing maintenance plans are available (and optional). Clients may receive discounted or free maintenance if they utilize other 25 Hours Consulting content services. Clients will be given access to their sites upon request and only upon project completion. The Company is not responsible for changes made to the site by the Client, or problems that arise from any such changes outside of the advice of the Consultant. Other terms and conditions may apply.

Any clients seeking the professional guidance and assistance of 25 Hours Consulting to reformat a resume or help with job board postings retain all responsibility for the ultimate presentation of their information and the resulting outcomes achieved. Once a resume has been completed or job board postings have been customized, it is up to the client to continue searching, monitoring, and responding to any resulting job activity. 25 Hours Consulting does not manage or get involved in the job search process beyond ensuring the initial marketability of its client. Furthermore, if changes are requested after payment is received for the completion of this service, another billable service may commence, depending on the degree of change necessary. Resume preparation and job board posting services may be eligible for inclusive revisions within the scope and time-frame of the current project, the extent and quantity of which shall remain at the discretion of the Company. Failure to obtain an interview or land a position will not in any way reflect upon the Company.
